1. Agreement to Terms & Code of Tehzeeb

By accessing or utilizing Explore Lucknow (the “Portal”, accessible at https://explorelucknow.in), you signify your binding agreement to these Terms of Service (“Terms”) under the Indian Contract Act, 1872. If you disagree with any part of these terms, please do not use the portal.

Lucknow is world-renowned for its Tehzeeb (grace, etiquette, and mutual respect). All users, visitors, and listed merchants are expected to conduct their interactions with dignity, truthfulness, and goodwill.

2. Intermediary Status & Section 79 IT Act Safe Harbor

Explore Lucknow acts strictly as an information intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000.

• The Portal serves as a digital index connecting consumers with independently operated third-party eateries, handloom houses, healthcare clinics, hotels, and local businesses in Lucknow.
• Explore Lucknow does not own, prepare food for, manufacture goods for, or manage the staff of any listed third-party establishment.
• Under Section 79 of the IT Act, 2000, Explore Lucknow is not liable for third-party information, menu changes, product quality, service deficiencies, pricing discrepancies, or customer grievances arising from transactions with listed merchants.

3. Business Listings & Merchant Guidelines

Merchants and establishment owners who list their business or purchase promotional spotlights (₹99 Lifetime Listing, Silver, Gold, or Platinum tiers) agree to:

• Provide accurate, genuine, and verified contact numbers (Phone / WhatsApp), physical Lucknow addresses, and realistic descriptions.
• Refrain from listing counterfeit products, unauthorized imitations of registered Chikankari GI brands, illegal services, or deceptive discounts.
• Acknowledge that Explore Lucknow reserves the absolute right to reject, edit, or delist any establishment that violates local laws, generates substantiated customer fraud complaints, or breaches Indian advertising codes.

4. Nominative Fair Use & Intellectual Property

All proprietary code, bespoke software architecture, editorial Dastangoi articles, layout graphics, and curated compilation databases on Explore Lucknow are the intellectual property of Explore Lucknow and protected under the Indian Copyright Act, 1957.

Names of iconic Lucknow establishments (such as Tunday Kababi, The Mughal's Dastarkhwan, Ada Designer Chikan Studio, etc.) are cited strictly under the doctrine of Nominative Fair Use under Section 30 of the Trade Marks Act, 1999, for the lawful purpose of public directory indexing, factual identification, and heritage appreciation.

5. Direct Rabta (Communication) Between Users & Shops

When you click direct "Call" or "WhatsApp" buttons on our platform, you establish a direct, private communication channel with that independent merchant. Explore Lucknow is not a party to any contract, sale of goods, table reservation, or home delivery agreement entered into between you and the shopkeeper.

6. Limitation of Liability

To the fullest extent permissible under Indian law, Explore Lucknow and its operators, affiliates, and representatives shall not be liable for any indirect, incidental, punitive, or consequential damages arising from:

• Reliance on pricing, opening hours, or promotional offers published on the portal.
• Unavailability, power cuts, or route diversions indicated via third-party GPS mapping services (Google Maps).
• Food quality, dietary allergies, hygiene conditions, or service experiences at listed restaurants.
